to capture latias in sapphire, does the pokemon in the lead of your party have to be lower then 50?

only asking becase i cought latios without any problems with a lvl46 pokemon, but now i 'm trying to capture latias with a lvl 52 pokemon and i've been at it for 3 hours now and i din't see latias, and latios just took me 20 something menutes.

No. It seems like yer just having rotten luck. Track it with the pokedex, then just keep an eye on it when it traves away. That's all I can tell you.
