Harry Potter Years 5-7 Problem

Hey hopefully someone out there has had this problem with HP years 5-7. This issue was not there in our other HP game (years 1-4). When working as an HP character, I can not change spells (or if I am Hermione or Ron, I can not change to the rat/cat). In the first game, you just held down C on the nunchuck, then a spell/character circle would pop up and you would then chose what you wanted. I can't get that popup circle to show. First I thought it was the game, so I took it back where I got it and they gave me a new copy, but it is doing it with the second copy. ANY IDEAS, I'm confused?

I bought HP 5-7 twice from Toys r us,and both of them have your problem. Also wont let me drink potions.Totally frustrated

This sounds like terrible game programming to me... At worst, you should at least be able to get a full refund for games that aren't working as they should.
