3ds friend question

can u only see if your friends are online if they are playing a 3ds online game or in the system menu too?

You can see what they are doing at all times even if they are in the system setting. Although you can set it so people can not see what you are doing.

well does it work if i close my 3ds? Also how is spotpass going to work with this situation. i have internet and close my 3ds. when i opened it and it said streetpass then 5 sec. later it said internet. is this normal ?
