This was done by Rare....are Rare games a place we won't be able to go with the VC?

Thats a tough question. The license at the time was for Nintendo I think but now its with Microsoft. I don't know much about licensing but I think they cant because Rare is licensed to Microsoft... But Diddy Kong Racing came out on the DS so i think they could. Don't know if they will. Not sure if what I said is at all true so wait for someone else to post that can help you out more.

Well Donkey Kong Country was made by Rare and it was released. But since DK is nintendo's character I guess they can do whatever they want with him. But anything is possible.

this situation is very unlikely, unless nintendo paid microsoft/rare money to release some of their games on the vc

Actually Battle Toads was done by more than just Rare. So Nintendo can easily get this game for VC. I think Battle Toads and Double Dragons was entirely done by Tradewest.
