Used Wii Us Said to Give New Owner Access to Previous Owner’s Downloads

Eurogamer reports today on a story from NeoGAF that says that anyone buying a previously owned Wii U will be able to access and download any previous content that the person who owned the console before them had bought. According to NeoGAF, this will happen even if the person who sold the console removed their account from it, and even if they wiped the hard drive clean before selling the console, which is what most people would do. The story relates the example of one person who bought a second-hand Wii U, and was amazed (and presumably quite pleased!) to discover that he was able to download Trine 2 and Nano Assault Neo. Eurogamer says that it is believed that this glitch is occurring because licenses for DLC are attached to specific Wii Us, not to the user account, which means that everyone who uses the particular console has access to the content, not just the person who purchased the content. Apparently the only way in which you can recover your Nintendo Network ID from a Wii U that you want to sell is to apply to Nintendo customer support, which Eurogamer says only Nintendo of America has said it will do. As Eurogamer says, it’s good and bad news! Bad news for Nintendo, because people will have access to games that they have not paid for, but good news for anyone buying a second-hand Wii U, who might get a bunch of free games! Eurogamer has asked Nintendo to comment on the issue.

I'm confused. Isn't the licenses always tied to the hardware, hence the complicated Wii -> Wii U upgrade process?
