That would require the special pre-order DLC, available only from Gamestop. Without it, you're stuck with Shoolk, who comes with his own Minado. Here's a picture:

But no, he probably won't be in the game. However, the first Xenoblade X trailer did show his face at the end. And the devs somehow got the protagonist of Xenogears into the story of Xenosaga and somehow avoided lawsuits, so it's not unheard of. Getting Shulk into the game somehow is technically possible and easier with it being the same series and all, although I'd be happier if he isn't in there at all aside from mere cameos. The first Xenoblade ended perfectly. There's no reason to include Shulk in a sequel.
