You can bring civil action on anyone, anytime - whether it actually results in anything is a separate issue. I imagine a *school* contract like you've described has some extremely loose language.

Stealing is a criminal sanction - so if you want to proceed along those lines, you should contact your local police department. BTW, he didn't steal in the sense you're thinking (i.e., larceny) - if anything it would be embezzlement if he kept it for his own use since he was entrusted to confiscate it.

Good lord, if I think about this anymore I'm going to need to break out my law books...

my ipod was taken up from my principle right
well in the school handbook
where my parents and i had to sign said
"any eletronics will not be tolerated during class and will be conviscated
and turned in to the local police station within 3 days where the parent of the child must go pick the item up along with a 15$ fee"

so its been 12 days and my priniciple has my ipod
if my parents had to sign i think it was a contract of agreement
and it has his signature on it
could i sue because he broke the contract?

or acuse him of stealing?

You could sue him for not providing adequate grammar and spelling education.

Once you get it back, I suggest that your parents take it from you. You need to be paying much more attention in school. Your writing and spelling is atrocious, even for a middle school student.

LoL!! I agree. You shouldn't have taken school knowing that electronics are not tolerated.

You are going to sue someone (whose title you cannot spell) for an opinion? Good luck.

And when you write do you skip a line every time you're supposed to take a breath in place of periods and commas?

long version:
If I was the school, I'd counter sue your parents for letting you break the rules. No one held a gun to your head making you take it in did they?

medium version:
you broke the rules, take it on the chin like a man

short version:
you're a foolish child.

Everyone does this. You can't ALL be serious when you say this
Your phones are meant to be on Silent. Are they? NEVER!
I think you're right to take your iPod, However, Use it at Lunch, Not in class.
I wouldn't sue, however it's stupid that he has handed it into police.
What it the police loose it? are you going to sue them
